This sounds like he is stepping his boundaries. Police officers have proticall they have to follow to what the law allows them too. Police officers can NOT do what ever they want, even though people think this. If he wrote you a ticket look up the cvc code. After you thoroughly read the law hopefully it address what is to be done if you are issued a ticket like this. I would be surprised if any where in this code section it gives an officer the power to take the fix in his hands like he did.
